What is Title IX?

Title IX refers to an amendment to the Education Amendments Act of  1972. It states: "No person in the United States shall, on the basis of sex, be excluded from participation, in be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” This means that educational institutions that receive federal financial assistance must take steps to prevent, stop, and remedy sexual discrimination and harassment. 

Who does Title IX protect?

Title IX provides protections for all people on a college campus, including staff, faculty, students, and visitors. 

What does Title IX prohibit?

Title IX prohibits discrimination and harassment on the basis of sex in education. This includes intimate partner violence, stalking, sexual assault, sexual discrimination and harassment, disparate treatment on the basis of sex, and other non-consensual sexual acts. 

What does a Title IX Coordinator do/not do?

The Title IX Coordinator is the main contact and coordinator for policy and procedure administration related to sex discrimination and harassment. A Title IX Coordinator serves in a compliance and equity capacity, NOT and advocacy capacity. 

What are some consequences for failure to comply with Title IX?

Institutions that fail to comply with Title IX often find themselves buried in ineffective process or policy, at best, and party to lawsuits at worst. Institutions can also face penalties such a fines, or possible loss of federal funding.  

Does Title IX provide protections for pregnant or parenting students?

Yes! Pregnant and parenting students have certain rights under Title IX, including taking leave, receiving reasonable modifications, and picking up where they left off in their program after leave.

Does Title IX provide protections for LGBTQIA+ individuals?

Yes! Title IX prohibits discrimination on the basis of sexual orientation, gender identity, and gender expression.

Why use external Title IX consultants?

There are many reasons institutions use external contractors for Title IX, including bandwidth limitations, and conflict of interest mitigation.
